The terms and conditions may change, and if this happens you will receive an alert or notification on the <\/span>\u201cCINEMA SHUTTLE\u201d <\/span>website and\/or through your email.<\/span><\/p>\n

I. GENERAL.<\/span><\/h3>\n

These terms and conditions govern the use of the <\/span>\u201cCINEMA SHUTTLE\u201d<\/span> platform (hereinafter <\/span>\u201cCINEMA SHUTTLE\u201d<\/span>) for its users.<\/span><\/p>\n

II. OWNER.<\/span><\/h3>\n

\u201cCINEMA SHUTTLE\u201d <\/span>is a website owned by <\/span>\u201c<\/span>CINEMA SHUTTLE S.A. DE C.V.\u201d<\/span>, a company incorporated under Mexican law, with its registered address located at:<\/span><\/p>\n

III. <\/span>THE SERVICE.<\/span><\/h3>\n

\u201cCINEMA SHUTTLE\u201d <\/span>is a digital and technology platform that provides its Lessors and\/or Suppliers with logistical intermediation services for the sublease and\/or, where applicable, operation and\/or storage services for specialized equipment for productions, through which such services are made available to Users on the website <\/span>https:\/\/cinema-shuttle.mx\/<\/a><\/span><\/p>\n

By accepting these terms and conditions, you acknowledge that the service provided, unless otherwise agreed, is for the exclusive use of the User registered on the platform and of no other individual, company, or entity, nor may the service be subcontracted.<\/span><\/p>\n

IV. CONDITIONS FOR USE OF THE WEBSITE.<\/span><\/h3>\n

This website must be used personally by legal entities and individuals through their authorized users, and by persons of legal age in accordance with Mexican law, all of whom must have a registration on the platform.<\/span><\/p>\n

Registration on the platform implies the User\u2019s consent and, ultimately, the User must complete a form that will collect the following information:<\/span><\/p>\n

  2. INCORPORATION DETAILS (for legal entities):<\/span><\/li>\n
  3. REPRESENTATIVE DETAILS (where applicable):<\/span><\/li>\n
  4. ADDRESS FOR NOTICES:<\/span><\/li>\n
  5. EMAIL ADDRESS:<\/span><\/li>\n
  6. CELL PHONE NUMBER WITH INTERNATIONAL DIALING CODE:<\/span><\/li>\n
  7. VALID OFFICIAL IDENTIFICATION OF THE HOLDER OR REPRESENTATIVE: (INE, IFE OR PASSPORT)<\/span><\/li>\n
  8. COVER PAGE OF A VALID BANK ACCOUNT STATEMENT ISSUED IN MEXICAN TERRITORY<\/span><\/li>\n
  9. TAX STATUS CERTIFICATE FOR THE CURRENT YEAR.<\/span><\/li>\n<\/ol>\n

    The User authorizes <\/span>\u201cCINEMA SHUTTLE\u201d <\/span>to use their personal data to carry out verification inquiries, including authorization for the System Administrator to share such personal data with other databases necessary to verify said personal data.<\/span><\/p>\n

    If this data is outdated, it may result in suspension of the service; therefore, it is the User\u2019s responsibility to keep this information updated. We remind you that the handling of this data may be reviewed in our Privacy Notice, through the website <\/span>https:\/\/cinema-shuttle.mx\/<\/a><\/span>.<\/span><\/p>\n

    Use of this platform by minors without supervision from the account holder is strictly prohibited; likewise, use by third parties unrelated to the account or similar unauthorized use is prohibited.<\/span><\/p>\n

    The User acknowledges that any damage, harm, or legal consequence arising from violation of these rules is the responsibility of the platform User and releases <\/span>\u201cCINEMA SHUTTLE\u201d <\/span>from any claim of a civil, criminal, administrative, or any other nature.<\/span><\/p>\n

    Likewise, the User is reminded that use of this platform for unlawful purposes, in contravention of the law or of these terms and conditions, shall be subject to legal liability and the corresponding authorities shall be notified immediately.<\/span><\/p>\n

    This service shall also be restricted if the User does not have the latest updated version of the <\/span>\u201cCINEMA SHUTTLE\u201d<\/span> website. <\/span><\/p>\n

    \u201cCINEMA SHUTTLE\u201d <\/span>is not responsible if the device used to access the website is not compatible and\/or ceases to be compatible with it.<\/span><\/p>\n

    Use of this website may be conditioned by other platforms and search engines developed by third parties, such as iOS, Android, or similar services that are independent from this agreement and with which there is no direct relationship under the terms hereof, and which may be reviewed in the intellectual property notice.<\/span><\/p>\n

    In the case of information regarding licenses used by third parties, these may imply leaving the website:<\/span><\/p>\n

      V. OPERATING CONDITIONS OF THE SERVICE ON THE PLATFORM<\/span><\/h3>\n

      The User must register an account and provide:<\/span><\/p>\n

        \n
      1. A bank credit or debit card. <\/span><\/li>\n
      2. Completion of a client onboarding process.<\/span><\/li>\n
      3. Payment of a deposit.<\/span><\/li>\n
      4. Provision of a check.<\/span><\/li>\n
      5. Provision of a performance bond or similar policy.<\/span><\/li>\n<\/ol>\n

        The foregoing must be sufficient to cover pre-charges for the number of lease services and\/or specialized goods services through the means provided by the website. For such purpose, it may be necessary to leave the website and access third-party payment platforms, and you are therefore advised to review their terms and conditions.<\/span><\/p>\n

        From validation of your payment, which may take up to 48 (forty-eight) hours to be reflected based on Central Time in Mexico City (GMT-6), you may receive confirmation of your order.<\/span><\/p>\n

        The User must always have sufficient approved prepaid funds available in order to use the service. The platform is not responsible for application of the payment for up to 48 hours from the time the payment is made.<\/span><\/p>\n

        VI. USER OBLIGATIONS<\/span><\/h3>\n

        Every User must be an individual or legal entity with legal capacity to enjoy rights and perform legal acts under the laws of the United Mexican States, or otherwise accept service of notices by court bulletin in Mexico City.<\/span><\/p>\n

        Likewise, you shall provide the legal address and email address at which you may be located; otherwise, the legal address shall be deemed to be the one appearing on the representative\u2019s or holder\u2019s identification and, in the absence of such information, you accept service by court bulletin in the local courts of Mexico City.<\/span><\/p>\n

        The User must guarantee that the data entered was obtained lawfully and in accordance with the regulations of the United Mexican States on the matter, avoiding any improper or unlawful purpose in relation thereto.<\/span><\/p>\n

        The User also undertakes to keep their information updated at all times and to provide all information necessary for <\/span>\u201cCINEMA SHUTTLE\u201d<\/span> to provide its service.<\/span><\/p>\n

        The User who subleases using<\/span> \u201cCINEMA SHUTTLE\u201d<\/span> shall select the goods they deem convenient, submitting the request through the <\/span>\u201cCINEMA SHUTTLE\u201d <\/span>platform and specifying the dates and duration of the selected lease. Any other request method shall be invalid and shall release<\/span> \u201cCINEMA SHUTTLE\u201d<\/span> from any liability.<\/span><\/p>\n

        \u201cCINEMA SHUTTLE\u201d<\/span> shall establish price lists and the conditions of use of the goods in detail on the platform, following the minimum instructions it may establish.<\/span><\/p>\n

        Once the service is confirmed, a request shall be generated detailing at least:<\/span><\/p>\n

          \n
        1. Subleased goods.<\/span><\/li>\n
        2. Service location.<\/span><\/li>\n
        3. Period of use.<\/span><\/li>\n
        4. Method of transportation.<\/span><\/li>\n
        5. Additional services.<\/span><\/li>\n
        6. Special service conditions (if any).<\/span><\/li>\n<\/ol>\n

          All services shall be pre-charged to the card or bank account authorized by the User and shall have a maximum value established on the platform, depending on the cost of said service. There may be restrictions regarding the service location if <\/span>\u201c<\/span>CINEMA SHUTTLE\u201d<\/span> considers it appropriate, or transportation expenses may vary on holidays in accordance with the work calendar of the United Mexican States.<\/span><\/p>\n

          Orders are confirmed with a non-refundable advance payment of at least 50% (fifty percent) and full payment at least twenty-four hours before delivery. In the event of late payment, Cinema Shuttle may reschedule or cancel without liability.<\/span><\/p>\n

          All services must be requested at least three days in advance in order to confirm them; otherwise, an additional fee will be charged and delivery will not be guaranteed, without liability for CINEMA SHUTTLE.<\/span><\/p>\n

          \u201cCancellation without penalty applies within 24 hours following the order and at least 48 hours before delivery. After that, the User shall cover (i) transportation\/handling costs, (ii) accrued rental days, and (iii) non-refundable third-party charges.\u201d<\/span><\/p>\n

          The User, either personally or through an authorized representative, must appear at the delivery location of the goods and carry out a physical inspection of the goods subject to sublease, and a photographic and video inspection report shall be created for clients.<\/span><\/p>\n

          Following inspection and approval of the goods, the service order shall be deemed fully validated without modifications, except for defects resulting from ordinary, proper, and continued use of the equipment.<\/span><\/p>\n

          If the User declines to sign for or accept the goods at the time of delivery, they must state and document the reasons for such refusal on the <\/span>\u201cCINEMA SHUTTLE\u201d<\/span> platform as soon as possible, subject to the platform\u2019s acceptance of such refusal.<\/span><\/p>\n

          \u201cCINEMA SHUTTLE\u201d,<\/span> may in such case offer alternative goods of similar quality at no additional charge to the User, provided that such goods are effectively registered on the platform and the sublessee accepts them.<\/span><\/p>\n

          If no goods are available<\/span>, <\/span>\u201cCINEMA SHUTTLE\u201d<\/span> shall seek other available goods on its platform on a best-efforts basis and, failing that, shall refund the service, being excluded from any further liability. <\/span><\/p>\n

          In the event of acceptance, it shall be presumed that the User has received the goods to their full satisfaction, in the condition in which they are found, comparing the characteristics of the goods with those described in the service order.<\/span><\/p>\n

          The User must return the leased goods in the same condition in which they were received at the start of the lease, without prejudice to the obligations established in detail in the lease agreement.<\/span><\/p>\n

          The User must return the leased goods on the established date. If an extension of the lease term is required, the User must request a written extension before the expiration of the originally agreed term. If the goods are not returned on the established date and such extension has neither been requested nor authorized, the corresponding penalty shall apply.<\/span><\/p>\n

          The User has a period of five business days after signing the agreement to cancel the transaction without liability or penalty by requesting such refund from the relevant payment platform via email. <\/span>In order for the cancellation to take effect without penalty, it must be made within the established timeframes, that is, within 24 hours following the order and at least 48 hours before delivery.<\/span><\/p>\n

          The User must inform the Lessor or Supplier in writing through the <\/span>\u201cCINEMA SHUTTLE\u201d<\/span> platform of the reasons for such cancellation and, if the goods are in their possession, return them in person; in such case, transportation, towing, fuel, toll, accrued use, and insurance costs shall be borne by the User.<\/span><\/p>\n

          \u201cCINEMA SHUTTLE\u201d<\/span> shall refund, within the following ten business days after the cancellation is deemed applicable, any charge made, provided the preceding paragraph has been complied with.<\/span><\/p>\n

          VII. PAYMENTS AND ISSUANCE OF TAX RECEIPTS<\/span><\/h3>\n

          Payments to <\/span>\u201cCINEMA SHUTTLE\u201d<\/span> shall always be requested through its platform or by email, accepting the following methods exclusively for the account holder:<\/span><\/p>\n

          1. POS terminal. (Point-of-sale terminal)<\/span><\/li>\n

          4. Bank deposit by sending proof of payment and subject to confirmation of cleared funds.<\/span><\/li>\n<\/ol>\n

            If <\/span>\u201cCINEMA SHUTTLE\u201d<\/span> detects suspicious use in payments and payment methods by a User, it may block the service, giving due notice to Users.<\/span><\/p>\n

            If the User needs to request any type of credit in order to obtain the service, they must submit such request by email to <\/span>hola@cinema-shuttle.mx<\/a><\/span>, indicating the reason for such request, in which case <\/span>\u201cCINEMA SHUTTLE\u201d, <\/span>will send the documentation necessary to analyze it.<\/span><\/p>\n

            Users may obtain tax receipts for the service through the billing portal by entering the website <\/span>https:\/\/cinema-shuttle.mx\/<\/a><\/span>, or by email at <\/span>hola@cinema-shuttle.mx<\/a><\/span>, <\/span>for which they must provide a valid tax status certificate for the United Mexican States. <\/span><\/p>\n

            VIII. LEASE AND OPTION TO PURCHASE OR LEASING <\/span><\/h3>\n

            Unless otherwise agreed, <\/span>\u201cCINEMA SHUTTLE\u201d <\/span>shall provide Users with the lease terms for execution thereof. <\/span><\/p>\n

            Users may view purchase offers for the equipment registered on the platform through leasing schemes, traditional credit, or outright purchase and sale.<\/span><\/p>\n

            The conditions of these options are not mandatory and shall be the responsibility of the Lessees and Suppliers and the Users who accept them, with <\/span>\u201cCINEMA SHUTTLE\u201d<\/span> having a preferential right of acquisition.<\/span><\/p>\n

            If the lease includes an option to purchase, credit, or leasing, you acknowledge that \u201c<\/span>CINEMA SHUTTLE\u201d <\/span>acts as a commercial agent and\/or commission agent and is entitled to 3% (three percent) of the agreed transaction value.<\/span><\/p>\n

            IX. INTELLECTUAL PROPERTY.<\/span><\/h3>\n

            All copyrights contained on this website are protected under Mexican law. Improper exploitation thereof may be sanctioned by the applicable laws and authorities.<\/span><\/p>\n

            Users of \u201c<\/span>CINEMA SHUTTLE\u201d<\/span> may not dispute rates, reproduce procedures, or carry out outside the platform any contracts intended to be entered into within it. Likewise, the platform\u2019s databases are its property and are considered trade secrets for purposes of the Federal Law for the Protection of Industrial Property of the United Mexican States and its provisions on unfair competition.<\/span><\/p>\n

            All use related to trademarks, logos, and photographs of the equipment belongs to their respective owners, and \u201c<\/span>CINEMA SHUTTLE\u201d<\/span> allows their use solely for informational purposes, as it is not the owner of such equipment or images.<\/span><\/p>\n

            X. DATA PROTECTION<\/span><\/h3>\n

            The personal data that Users may provide is protected by the Personal Data Protection Law Held by Private Parties; to learn about this information in detail, you may consult the privacy notice available on the website <\/span>https:\/\/cinema-shuttle.mx\/<\/a><\/span><\/p>\n

            XI. LIMITATION OF LIABILITY<\/span><\/h3>\n

            \u201cCINEMA SHUTTLE\u201d<\/span> is a digital platform and shall not be liable to the User in any of the following cases:<\/span><\/p>\n
